Documents Needed to Sell Property in Spain

The easiest time to uncover missing property paperwork is before the first serious buyer asks for it. In Costa Blanca North and the Costa del Sol, delays often come from a mismatch between the property as marketed and the documents available at the notary – an extension, an old mortgage charge, missing inheritance papers or unpaid community fees.

The core seller file

  • Identity: passport or identity document, NIE/NIF and details of every registered owner.
  • Title deed (escritura) and an up-to-date Land Registry extract (nota simple).
  • Latest IBI receipt and cadastral reference details.
  • Community-of-owners information where applicable, including the amount of regular charges and evidence of outstanding debts.
  • Current energy performance certificate and registered energy label where required.
  • Mortgage redemption details if a charge remains registered.
  • Utility information and any relevant service contracts.

Documents depend on the home, not just the town

An apartment in a managed community has different questions from a detached villa with a pool or a rural property. Your lawyer may need to check building licences, declarations, licences of first/second occupation or equivalent documentation, cadastral and registry descriptions and whether alterations were properly recorded. There is no honest universal checklist that makes these checks unnecessary.

Three issues worth checking before photography

1. The physical property matches the paperwork

If a garage, additional bedroom, roof terrace, extension or pool is being offered as part of the sale, make sure its legal and practical status has been checked. Never assume a feature is included simply because it is physically accessible or was shown in an old advert.

2. The seller is actually able to sign

If all registered owners will not attend the notary, your lawyer may recommend a properly drafted power of attorney. In an inherited-property sale, the succession and title position should be checked before marketing timelines are promised.

3. Outstanding charges are understood

A mortgage balance is not the same as completing the formal cancellation of its registry entry. Likewise, community arrears and IBI liabilities should be identified early so completion figures can be agreed.

What should a non-resident owner add?

The legal team should confirm the seller’s tax position, relevant residency evidence, the non-resident 3% withholding and any arrangements needed to receive or transfer the proceeds. If the seller cannot travel to Spain, discuss powers of attorney well in advance.

What 1 Real Estate can coordinate

When a property is instructed, the local 1 Real Estate team can help gather the information needed for an accurate listing, explain the marketing process and remain in contact with the seller and lawyer as the transaction progresses. Legal certification, title checks and tax returns remain the work of appropriately qualified professionals.

A useful rule for owners

Before you publish a photograph, check that the description can be supported. Before you accept an offer, check that the documents required to complete the transaction can be produced. Doing those two things early prevents avoidable disputes later.
