A seller can agree to a higher price than they originally paid and still be surprised by the taxable gain. In Spain, capital gains tax is normally based on the difference between adjusted acquisition and disposal values. It is not automatically a percentage of the full selling price.
How the gain is calculated
Start with the acquisition price, then add qualifying acquisition taxes, notary/registration costs and eligible capital improvements. Separately, start with the sale price and deduct qualifying costs of disposal paid by the seller. Tax rules also require adjustments for some properties that have been rented out, including relevant depreciation. Routine maintenance is not automatically a capital improvement.
Illustrative example
| Item | Amount |
| Original purchase price | ā¬200,000 |
| Qualifying purchase tax and costs | ā¬20,500 |
| Adjusted acquisition value | ā¬220,500 |
| Sale price | ā¬300,000 |
| Qualifying sale costs (illustrative) | ā¬5,230 |
| Adjusted sale value | ā¬294,770 |
| Illustrative capital gain | ā¬74,270 |
The example is intentionally simplified. An accountant or tax adviser should validate each cost, any ownership shares and deductions. A ā¬74,270 gain is not the same as ā¬300,000 of taxable income.
If you are a Spanish tax resident
Property gains are generally included in the savings component of Spanish personal income tax. The combined savings-income bands in force from 2025 are 19% on the first ā¬6,000, 21% on the next ā¬44,000, 23% from ā¬50,000 to ā¬200,000, 27% from ā¬200,000 to ā¬300,000, and 30% above ā¬300,000. These bands apply to the relevant savings tax base overall, not as a flat rate calculated only on one property transaction.
Selling your main home and buying another
A qualifying Spanish taxpayer may obtain an exemption for all or part of a gain on their main residence when the proceeds are reinvested into another qualifying main residence within the statutory period. The general reinvestment window is two years before or after the sale, subject to the detailed conditions. This relief is not automatic and should be planned before completion.
What changes when the seller is over 65?
A person over 65 who sells a qualifying habitual residence may be exempt from Spanish capital gains tax on that sale. Age alone is not enough: the property must meet the habitual-residence conditions, and the seller’s tax status matters. A holiday apartment does not become exempt simply because its owner is 66. There are separate rules concerning qualifying life-annuity reinvestment for other assets, which require specialist advice.
If you are not a Spanish tax resident
The taxable gain on Spanish property is generally charged at 19% under non-resident income tax. When the property is sold, the buyer normally withholds 3% of the consideration attributable to the non-resident owner. That withholding is credited against the final tax and may result in an additional payment or a refund.
Being a British citizen, holding a Spanish residence card or owning a home in Spain does not, by itself, decide where you are tax resident. Time spent in Spain and the centre of your economic interests are among the relevant tests. Where two countries could claim residence, the applicable tax treaty and facts need checking.
Before you accept an offer
- Find your purchase deed and evidence of acquisition taxes, notary and registration costs.
- Gather invoices for substantial improvements; distinguish these from repairs and furnishings.
- Ask for a clear estimate of selling costs and municipal plusvalia.
- If the property was rented, tell your tax adviser so depreciation rules can be checked.
- If claiming habitual-residence relief, verify eligibility before making decisions about moving or reinvesting.
Where 1 Real Estate fits in
1 Real Estate can establish a realistic selling price and explain the agency terms. The tax calculation must be made for the owner by a qualified tax professional. This separation helps sellers understand both the market value of the property and the likely net proceeds.
